Часы Apple iWatch будут зарегистрированы в России

На днях стало известно, что корпорация Apple подала заявку на регистрацию в Роспатенте товарного знака iWatch (есть в распоряжении «Известий»). Слухи о предстоящем появлении на рынке часов от этой фирмы давно ходят по интернет-форумам любителей «яблочной» продукции, но официальных сообщений от представителей компании, появятся ли умные часы и как они будут называться, не было. Заявка подана по двум классам Международной классификации товаров и услуг (МКТУ) — 9-му (компьютеры, периферийные устройства для них и др.) и 14-му (часы и др.).

— Часы относятся к 14-му классу, — поясняет специалист компании «Патентус» Анастасия Спильник. — Но iWatch от Apple, как ожидается, станут многофункциональным мобильным устройством, и функция определения времени будет далеко не основной. Поэтому их также следует отнести к электронным устройствам — это 9-й класс МКТУ.

В начале года блогеры нашли на сайте Бюро патентов и торговых марок США поданную Apple заявку на любопытный патент. Это браслет, который пользователь может носить на запястье. На сенсорный экран устройства через беспроводную связь выводится информация с iPhone, и владелец имеет возможность переключать песни в плеере или просмотреть недавние звонки. Гибкий дисплей будет оснащен виртуальной клавиатурой, что даст возможность писать сообщения прямо на экране часов. По данным аналитиков Bloomberg, часы от Apple будут представлены публике уже в конце этого года.

Название устройства не сообщалось, но СМИ — по аналогии со смартфоном iPhone, планшетом iPad — окрестили его iWatch. Впервые Apple зарегистрировала товарный знак iWatch на Ямайке 3 декабря 2012 года.

— Если Роспатент примет решение о регистрации российской заявки, правовая охрана товарного знака будет действовать с указанной даты приоритета, — замечает руководитель отдела товарных знаков «Патентуса» Лариса Грудина.

При этом в нескольких странах (США, Италия, Швейцария, Австралия и др.) различные компании уже успели зарегистрировать на себя товарные знаки, включающие словесный элемент iWatch в различном написании. В Соединенных Штатах в 2004 году Quest Software, Inc. зарегистрировала бренд I/WATCH, а в 2007 году Viva Vision, Inc. — IWATCH. В обоих случаях речь идет о 9-м классе. Сейчас в патентном ведомстве США рассматривается заявка фирмы M. Z. Berger & Co., Inc. на регистрацию IWATCH по 14-му классу МКТУ.

Не всё просто с этим сочетанием букв и в России. В 2006 году был зарегистрирован товарный знак i-watch.ru. Российский предприниматель Дмитрий Титов, владелец одноименного домена, зарегистрировал его по 35-му классу МКТУ (маркетинговые исследования и др.). Сейчас на сайте i-watch.ru — интернет-магазин по продаже часов.
По мнению патентного поверенного компании «Зуйков и партнеры» Ольги Плясуновой, в случае регистрации товарного знака компанией Apple правообладатель i-watch.ru сможет через суд потребовать аннулировать его. Но шансов на победу немного, поскольку речь идет о разных классах МКТУ.

— Пока сложно оценить шансы успешной регистрации заявки Apple в России, — считает Грудина. Она вспоминает, что в 2011 году для другой компании Роспатент отказался регистрировать iWatch по 14-му классу из-за сходства с ранее зарегистрированным знаком iswatch (правообладатель — всемирно известный швейцарский производитель часов Swatch AG).
